These terms are an agreement between you and Eight Mile, company number 15938227, registered in England and Wales (“Eight Mile”, “we”) for the PencePal app and the website at pencepal.com. They are also the licence agreement for the app. By creating an account or using PencePal you accept them. How we handle your data is in the privacy policy.
What PencePal is, and is not
- PencePal is a bookkeeping record: it keeps the expenses, receipts, mileage and date ranges you enter, and makes documents from them.
- It is not tax, accounting, financial or legal advice. Categories, mileage rates and tax years are shown as HMRC publishes them, for your convenience; whether and how they apply to you is for you, or your accountant, to decide. You remain responsible for your tax returns and the records you keep.
- PencePal has no connection to your bank and moves no money. It never makes, takes or holds a payment, except that PencePal Pro is bought through the App Store or Google Play.
Your account
You must be 18 or over. Give a correct email address, keep your password and devices secure, and tell us at [email protected] if you think someone else has used your account. An account is for one person, though it may hold a business's records.
PencePal Pro
- PencePal Pro adds features to the app, such as scanning receipts and insights. It is a subscription, monthly or yearly, sold only through the App Store and Google Play. The website shows whether you have it but sells nothing. Viewing, exporting and deleting your records are never behind the subscription.
- The price and the length of each period are shown in the store before you confirm. Payment is taken by the store, from the account you buy with, when you confirm.
- Renewal: the subscription renews automatically at the end of each period, at the price then shown, unless you cancel before the period ends. The App Store asks for at least 24 hours' notice before the end of the period.
- Free trial: a plan may start with a free trial, whose length the store shows before you confirm. When it ends, the paid subscription starts and you are charged unless you cancel before the end of the trial. Any unused part of a trial ends when you buy a subscription.
- Cancelling is done in the store: App Store subscriptions or Google Play subscriptions. You keep Pro until the end of the period you have paid for. Deleting your PencePal account does not cancel a subscription.
- Refunds are handled by the store, under its own rules. Nothing in these terms affects your statutory rights as a consumer.
Licence
We give you a personal, non-exclusive, non-transferable licence to use the app and the website for your own records, under these terms. We keep all rights in PencePal itself. You may not copy, resell, or try to extract the source of the app, except where the law allows it.
Acceptable use
Do not use PencePal to:
- break the law, or keep records you have no right to keep;
- upload anything harmful, such as malware, or anything that is not a receipt or a record;
- try to reach another person's account or data, test or overload our systems, or get round a limit or a lockout;
- resell or share access to PencePal as a service to others.
If you connect an AI client through an AI connector, you are responsible for what it does with your account. We may suspend an account used in breach of these terms, and will tell you why unless the law or security prevents it.
Your records
What you put in PencePal stays yours. You allow us to store, process and show it only to provide PencePal to you, as the privacy policy describes. You can download all of it, or delete it, at any time.
Availability and changes
We work to keep PencePal available and your records safe, but cannot promise it will always be available or free of faults, so keep your own copy of anything you must not lose (Download my data gives you one). We may change or withdraw features; if a change takes away something you pay for, we tell you first. We may update these terms, and will tell you in the app or by email before a change that matters takes effect.
Liability
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
- We are not liable for losses that come from how you use your records, such as a tax return, a penalty or a business decision, since PencePal does not advise you; nor for losses that were not foreseeable, or business losses such as lost profit.
- Otherwise, our total liability to you is limited to what you paid for PencePal Pro in the 12 months before the claim.
Ending
You can stop using PencePal and delete your account whenever you like (how to delete your account). These terms end when your account is deleted.
App Store
If you got the app from Apple's App Store, these terms also say:
- These terms are between you and Eight Mile, not Apple. Eight Mile, not Apple, is responsible for the app and its content.
- Your licence is to use the app on Apple-branded products you own or control, as the usage rules in Apple's Media Services Terms and Conditions allow, including through Family Sharing where it applies.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app, and any other claim, loss or cost from such a failure is Eight Mile's responsibility as these terms set out.
- Eight Mile, not Apple, is responsible for any claim about the app or your use of it, including product liability, a failure to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the app or your use of it infringes their intellectual property, Eight Mile, not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not in a country subject to a US Government embargo or designated as supporting terrorism, and that you are not on any US Government list of prohibited or restricted parties.
- You must also follow any third-party terms that apply when you use the app, such as your mobile network's.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them Apple may enforce them against you.
Questions, complaints or claims about the app go to Eight Mile, London, at [email protected].
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales may hear any dispute. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
